It is a constitutional demand for judges to be objective. Ethical codes show that objectivity depends on rules enabling individuals to counter their subjectivity. Yet these codes focus on judges’ general behaviour while methodology strives for objectivity in the judges’ core task of applying the law on a specific case. Various methods are examined whether they guarantee or at least contribute to an objective interpretation of the law within the existing margin of interpretation. Conscious application of methodology is elaborated upon (...) as a demand of a democratic state under the rule of law. While the principle of judicial independence already limits control of the external result of the adjudication process, it is almost impossible to control the internal process of applying the law that takes place only inside the judge’s head. Thus, it is up to each judge to ensure objectivity by internally binding themselves to a conscious application of methods - therefore constituting an ethical demand. (shrink)

Die betriebliche Leistungsprogrammplanung legt die Fallklassen, die Patientenzahl pro Fallklasse sowie die Fachabteilungen eines Krankenhauses fest. Der vorliegende Artikel untersucht die Auswirkung unterschiedlicher Zielsysteme auf das Leistungsprogramm. Hierzu wird ein Modell der Linearen Programmierung entwickelt und für Zielfunktionen (z. B. Gewinnmaximierung, Bedarfsdeckung, Gewinnmaximierung unter Nebenbedingungen, Risikominimierung) berechnet. Es zeigt sich, dass ein gewinnmaximales Leistungsprogramm zu einer Selektion von Fallklassen führt, so dass eine umfassende Versorgung nicht mehr gewährleistet ist. Diese Zielfunktion ist folglich nur zulässig, falls ein Versorgungsverbund unter Aufrechterhaltung des (...) Sicherstellungsauftrages existiert. Ethische Erwägungen, wie z. B. die Aufrechterhaltung besonderer Abteilungen (z. B. Neonatalintensiv) unabhängig von ihrer Ertragslage, führen in der Regel zu einer wirtschaftlichen Schlechterstellung des Krankenhauses. Die Risikominimierung führt zu einer Standardtherapie, während eine Patientenorientierung im Rahmen der Individualisierten Therapie das Verlustrisiko erhöht und damit insbesondere für kleinere Krankenhäuser unannehmbar ist. This article discusses a peculiar Sā$$\dot {\text{n}}$$n˙khya-Yoga theory of transformation (pariṇāma) that the author of the Pātañjalayogaśāstra created by drawing upon Sarvāstivāda Buddhist theories of temporality. In developing his theory, Patañjali adaptively reused the wording in which the Sarvāstivāda theories were formulated, the specific objections against these theories, and their refutations to win the philosophical debate about temporality against Sarvāstivāda Buddhism. Patañjali’s approach towards the Sarvāstivāda Buddhist theories was possible, even though his system of Yoga is based on an ontology (...) that differs considerably from that of Sarvāstivāda Buddhism because both systems share the philosophical view that time is not a separate ontological entity in itself. Time is a concept deduced from change in the empirical world. This agreement results from the common philosophical orientation of Sarvāstivāda Buddhism and Yoga, which takes the phenomenon of experience as the basis of philosophical enquiry into the structure of the world. The intention that guided Patañjali’s adaptive reuse was twofold. On the one hand, he aimed at winning the debate with Sarvāstivāda Buddhism about how the problem of temporality can be solved. He thus integrated four mutually exclusive theories on temporality into a single theory of transformation of properties (dharma) involving a second-level and a third-level theory on the transformation of the temporal characteristic mark (lakṣaṇa) and on the transformation of states (avasthā), respectively. On the other hand, Patañjali intended to achieve philosophical clarification regarding the question of how exactly properties relate to their underlying substrate in the process of transformation of the three constituents or forces (guṇa) sattva, rajas and tamas of matter (pradhāna) that account for all phenomena of the world except pure consciousness (puruṣa). Patañjali’s theory of transformation is thus of central importance for his Sā$$\dot {\text{n}}$$n˙khya ontology, according to which the world consists of 25 categories or constituents (tattva), i.e., of primal matter (prakṛti) and its transformations and pure consciousness. Actions receive teleological descriptions and reason explanations. In some circumstances, these descriptions and explanations might appeal not just to the agent’s own purposes and reasons, but also to the purposes and reasons of others in her social surroundings. Some actions have a social teleology. I illustrate this phenomenon and I propose a concept of vicarious action to account for it. An agent acts vicariously when she acts in response to the demand of another agent who knew that her demand was (...) likely to succeed. I argue that vicariousness grounds the social teleology of the resulting actions. (shrink)

The folk picture of agency suggests that human beings have basic agency over some of their omissions. For example, someone may follow through on a decision never to support a political party without doing anything in order to make themselves omit. A number of features appear to signal their agency: the omission is not just called intentional, it is also seen as an achievement and explained in terms of the reasons for the decision. Some philosophers have tried to debunk the (...) appearance and argue that agency over omissions always proceeds from agency over actions (on the model of Ulysses ordering his crew to tie him to the mast). Others have tried to uphold the appearance by understanding basic agency over omissions on the model of their theories of action (and most often on the model of causal theories). Against both groups, I argue for a vindication of the appearance in terms of a theory of sui generis basic agency over omissions. Basic intentional omissions are the behavioral outcomes of fluent control by their agents’ intentions. When an intention to omit fluently controls for the right omission, the omission is an intentional achievement performed because of the intention. The intention appropriately regulates the agent’s behavior so as to ensure the intended omission. We can therefore see basic agency over omissions as regulative and distinct from the agency exercised over actions. (shrink)

Motivated by results of Bagaria, Magidor and Väänänen, we study characterizations of large cardinal properties through reflection principles for classes of structures. More specifically, we aim to characterize notions from the lower end of the large cardinal hierarchy through the principle [math] introduced by Bagaria and Väänänen. Our results isolate a narrow interval in the large cardinal hierarchy that is bounded from below by total indescribability and from above by subtleness, (...) and contains all large cardinals that can be characterized through the validity of the principle [math] for all classes of structures defined by formulas in a fixed level of the Lévy hierarchy. Moreover, it turns out that no property that can be characterized through this principle can provably imply strong inaccessibility. The proofs of these results rely heavily on the notion of shrewd cardinals, introduced by Rathjen in a proof-theoretic context, and embedding characterizations of these cardinals that resembles Magidor’s classical characterization of supercompactness. In addition, we show that several important weak large cardinal properties, like weak inaccessibility, weak Mahloness or weak [math]-indescribability, can be canonically characterized through localized versions of the principle [math]. Finally, the techniques developed in the proofs of these characterizations also allow us to show that Hamkin’s weakly compact embedding property is equivalent to Lévy’s notion of weak [math]-indescribability. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. We study the influence of the existence of large cardinals on the existence of wellorderings of power sets of infinite cardinals κ with the property that the collection of all initial segments of the wellordering is definable by a Σ1‐formula with parameter κ. A short argument shows that the existence of a measurable cardinal δ implies that such wellorderings do not exist at δ‐inaccessible cardinals of cofinality not equal to δ and their successors. In contrast, our main result shows that (...) these wellorderings exist at all other uncountable cardinals in the minimal model containing a measurable cardinal. In addition, we show that measurability is the smallest large cardinal property that imposes restrictions on the existence of such wellorderings at uncountable cardinals. The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. To put it differently, what matters is what is originally given within experience and not how you feel about what is given. (shrink)

How ethical have recent banking practices been? We answer this question via an economic analysis. We assess the two dominant practices of the modern banking system – fractional reserves and maturity transformation – by gauging the respective rights of the relevant parties. By distinguishing the legal and economic differences between deposit and loan contracts, we determine that the practice of maturity transformation (in its various guises) is not only ethical but also serves a positive social function. The foundation of the (...) modern banking system – the holding of fractional reserves against deposits – is, however, problematic from economic, legal and ethical perspectives. Starting from a microanalysis of money's function, a reassessment of the current laws concerning the practice is encouraged, with the aim not only to rectify economic irregularities but also to realign depositors' rights with the obligations of the banking sector. Cross-cultural comparisons often investigate values that are assumed to have long-lasting influence on human conduct and thought. To capture and compare cultural values across cultures, Geert Hofstede's Cultural Dimensions Theory has offered an influential framework. Hofstede also provided a survey instrument, the Values Survey Module (VSM), for measuring cultural values as outlined in his Cultural Dimensions Theory. The VSM has since been subject to a series of revisions. Yet, data on countries have been derived from the original VSM — and (...) not on one of the revised versions of VSM. We tested three scales (indulgence, power distance, and individualism) from the latest version, the VSM 2013, as part of a larger survey across 57 countries. Two main findings emerged. For one thing, country scores based on the VSM 2013 scales correlated only weakly with country scores of the same cultural dimensions obtained in a large previous study. Thus, the validity of the VSM 2013 is in doubt. For another thing, the internal consistency of the VSM 2013 scales was overall poor, indicating that the scales did not reliably measure well-defined constructs. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

Background: Mental healthcare needs person-tailored interventions. Experience Sampling Method (ESM) can provide daily life monitoring of personal experiences. This study aims to operationalize and test a measure of momentary reward-related Quality of Life (rQoL). Intuitively, quality of life improves by spending more time on rewarding experiences. ESM clinical interventions can use this information to coach patients to find a realistic, optimal balance of positive experiences (maximize reward) in daily life. rQoL combines the frequency of engaging in a relevant context (a (...) ‘behavior setting’) with concurrent (positive) affect. High rQoL occurs when the most frequent behavior settings are combined with positive affect or infrequent behavior settings co-occur with low positive affect. Methods: Resampling procedures (Monte Carlo experiments) were applied to assess the reliability of rQoL using various behavior setting definitions under different sampling circumstances, for real or virtual subjects with low-, average- and high contextual variability. Furthermore, resampling was used to assess whether rQoL is a distinct concept from positive affect. Virtual ESM beep datasets were extracted from 1058 valid ESM observations for virtual and real subjects. Results: Behavior settings defined by Who-What contextual information were most informative. Simulations of at least 100 ESM observations are needed for reliable assessment. Virtual ESM beep datasets of a real subject can be defined by Who-What-Where behavior setting combinations. Large sample sizes are necessary for reliable rQoL assessments, except for subjects with low contextual variability. rQoL is distinct from positive affect. Conclusion: rQoL is a feasible concept. Monte Carlo experiments should be used to assess the reliable implementation of an ESM statistic. Future research in ESM should asses the behavior of summary statistics under different sampling situations. This exploration is especially relevant in clinical implementation, where often only small datasets are available. (shrink)

Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. I support this view by proposing common normative (...) principles that specify when exploratory concept formation and tool development succeed to initiate scientific change. (shrink)

Peter Lombard is best known as the author of a celebrated work entitled Book of Sentences, which for several centuries served as the standard theological textbook in the Christian West. It was the subject of more commentaries than any other work of Christian literature besides the Bible itself. The Book of Sentences is essentially a compilation of older sources, from the Scriptures and Augustine down to several of the Lombard's contemporaries, such as Hugh of Saint Victor and Peter Abelard. Its (...) importance lies in the Lombard's organisation of the theological material, his method of presentation, and the way in which he shaped doctrine in several major areas. Despite his importance, however, there is no accessible introduction to Peter Lombard's life and thought available in any modern language. This volume fills this considerable gap. Philipp W. Rosemann begins by demonstrating how the Book of Sentences grew out of a long tradition of Christian reflection-a tradition, ultimately rooted in Scripture, which by the twelfth century had become ready to transform itself into a theological system. Turning to the Sentences, Rosemann then offers a brief exposition of the Lombard's life and work. He proceeds to a book-by-book examination and interpretation of its main topics, including the nature and attributes of God, the Trinity, creation, angelology, human nature and the Fall, original sin, Christology, ethics, and the sacraments. He concludes by exploring how the Sentences helped shape the further development of the Christian tradition, from the twelfth century through the time of Martin Luther. (shrink)

Extending previous results from work on the complexity of cut elimination for the sequent calculus LK, we discuss the role of quantifier alternations and develop a measure to describe the complexity of cut elimination in terms of quantifier alternations in cut formulas and contractions on such formulas.

This paper proposes an analysis of the discursive dynamics of high-impact concepts in the humanities. These are concepts whose formation and development have a lasting and wide-ranging effect on research and our understanding of discursive reality in general. The notion of a conceptual practice, based on a normative conception of practice, is introduced, and practices are identified, on this perspective, according to the way their respective performances are held mutually accountable. This normative conception of practices is then combined with recent (...) work from philosophy of science that characterizes concepts in terms of conceptual capacities that are productive, open-ended, and applicable beyond the original context they were developed in. It is shown that the formation of concepts can be identified by changes in how practitioners hold exercise of their conceptual capacities accountable when producing knowledge about a phenomenon. In a manner similar to the use of operational definitions in scientific practices, such concepts can also be used to intervene in various discourses within or outside the conceptual practice. Using the formation of the concepts “mechanism” and “performative” as examples, the paper shows how high-impact concepts reconfigure what is at issue and at stake in conceptual practices. As philosophy and other humanities disciplines are its domain of interest, it is a contribution to the methodology of the humanities. (shrink)

Spatial, physical, and semantic magnitude dimensions can influence action decisions in human cognitive processing and interact with each other. For example, in the SNARC effect, semantic numerical magnitude facilitates left-hand or right-hand responding dependent on the small or large magnitude of number symbols. SNARC-like interactions of numerical magnitudes with the radial spatial dimension (depth) were postulated from early on. Usually, the SNARC effect in any direction is investigated using fronto-parallel computer monitors for presentation of stimuli. In such 2D setups, however, (...) the metaphorical and literal interpretation of the radial depth axis with seemingly close / far stimuli or responses are not distinct. Hence, it is difficult to draw clear conclusions with respect to the contribution of different spatial mappings to the SNARC effect. In order to disentangle the different mappings in a natural way, we studied parametrical interactions between semantic numerical magnitude, horizontal directional responses, and perceptual distance by means of stereoscopic depth in an immersive virtual reality (VR). Two VR experiments show horizontal SNARC effects across all spatial displacements in traditional latency measures and kinematic response parameters. No indications of a SNARC effect along the depth axis, as it would be predicted by a direct mapping account, were observed, but the results show a non-linear relationship between horizontal SNARC slopes and physical distance. Steepest SNARC slopes were observed for digits presented close to the hands. We conclude that spatial-numerical processing is susceptible to effector-based processes but relatively resilient to task-irrelevant variations of radial-spatial magnitudes. (shrink)

We argue for a return to political-economic fundamentals as the basis for analysing the public sphere and seek to establish a characteristic connection between digital-behavioural control and singularised audiences in the context of proprietary markets. In the digital constellation, it is less a matter of immobilising the citizen as a consumer but rather of their political activation – (...) albeit in conditions under which commercial interests have primacy: privatisation without privatism. Formal spaces have become commonplace conceptual and computational tools in a large array of scientific disciplines, including both the natural and the social sciences. Morphological spaces are spaces describing and relating organismal phenotypes. They play a central role in morphometrics, the statistical description of biological forms, but also underlie the notion of adaptive landscapes that drives many theoretical considerations in evolutionary biology. We briefly review the topological and geometrical properties of the most common morphospaces in the biological literature. In contemporary (...) geometric morphometrics, the notion of a morphospace is based on the Euclidean tangent space to Kendall’s shape space, which is a Riemannian manifold. Many more classical morphospaces, such as Raup’s space of coiled shells, lack these metric properties, e.g., due to incommensurably scaled variables, so that these morphospaces typically are affine vector spaces. Other notions of a morphospace, like Thomas and Reif’s skeleton space, may not give rise to a quantitative measure of similarity at all. Such spaces can often be characterized in terms of topological or pretopological spaces. (shrink)

Regulation is nothing without enforcement. This particularly holds for the dynamic field of emerging technologies. Hence, this article has two ambitions. First, it explains how the EU´s new Artificial Intelligence Act (AIA) will be implemented and enforced by various institutional bodies, thus clarifying the governance framework of the AIA. Second, it proposes a normative model of governance, providing recommendations to ensure uniform and coordinated execution of the AIA and the fulfilment of the legislation. Taken together, the article explores how the (...) AIA may be implemented by national and EU institutional bodies, encompassing longstanding bodies, such as the European Commission, and those newly established under the AIA, such as the AI Office. It investigates their roles across supranational and national levels, emphasizing how EU regulations influence institutional structures and operations. These regulations may not only directly dictate the structural design of institutions but also indirectly request administrative capacities needed to enforce the AIA. (shrink)

ABSTRACT:In response to criticism of empirical or “positive” approaches to corporate social responsibility (CSR), we defend the importance of these approaches for any CSR theory that seeks to have practical impact. Although we acknowledge limitations to positive approaches, we unpack the neglected but crucial relationships between positive knowledge on the one hand and normative knowledge on the other in the implementation of CSR principles. Using the structure of a practical syllogism, we construct a model that displays the key role of (...) empirical knowledge in fulfilling a firm’s responsibility to society, paying special attention to the implications of the “ought implies can” dictum. We also defend the importance of one particular class of empirical claims; namely, claims from the field of economics. Even positive economic theory, which is often criticized for endorsing profits rather than values, can cooperate in intriguing ways with non-economic concepts in the implementation of CSR goals. In the snowy heights, all attempts to master symbolically the challenging landscape was thwarted by vertigo, somnolence, and fatigue. After 1850, physiologists intervened, (...) using the Alpine terrain as a laboratory landscape that was ideally suited to examine one of the most threatening concerns offin de siècleindustrial societies: fatigue. This essay examines how the picturesque voyage turned into an experimental physiology of fatigue, and how the “wordless subjectivity” of romantic travelers turned into the “wordless objectivity” of life scientists. Emotion Review, Volume 14, Issue 4, Page 264-269, October 2022. Müller's position-taking view of emotions takes issue with the widely endorsed philosophical notion that emotional feelings are a form of consciousness in which we become acquainted with the evaluative properties of objects and events. Müller rejects this perceptual theory of emotions and casts doubt on the idea that it is through emotional feeling that we develop an awareness of value. In so doing, his proposal amounts to a denial of any (...) epistemic function of emotional feeling. Challenging such a radical move, in my commentary, I discuss several affective phenomena in which feelings do seem to serve an epistemic function. These cases pose problems for Müller's version of the position-taking view of emotion, at least in its current form. (shrink)

Global sourcing largely occurs from so-called emerging markets and developing economies. In these contexts, substantial leverage effects for sustainability in supply chains can be expected by reducing adverse impacts on society and minimising related risks. For this ethical end, an adequate understanding of the respective sourcing contexts is fundamental. This case study of South Africa’s mining sector uses institutional theory and the notion of institutional uncertainty to empirically analyse the challenges associated with establishing social sustainability. The case study research is (...) informed by 39 semi-structured interviews with top management representatives and various state and non-state decision makers in SA. Our findings suggest that sustainability in the institutional field is mainly shaped by the Social and Labour Plan institution, induced by state actors and mining companies’ practices. However, four weakening factors were identified that adversely affect this regulative institution, drive institutional uncertainty and allow for mining companies’ gradual decoupling. Contrastingly, complementing pressures of non-state actors limit institutional uncertainty and push toward mainstreaming the stipulations of the institution. This study contributes to the business ethics literature by providing an in-depth exploration of institutional uncertainty’s drivers and barriers within an upstream SC setting and shedding light on multiple actors’ interplay and relevance in sector-wide sustainability. The findings are condensed into three main propositions as well as an analytical framework as a basis for follow-up research. This case study helps practitioners understand and manage complexity that results from actor plurality and institutional uncertainty in EMDEs. (shrink)

As such, this activity needs to be combined with complex ethical reflections, and this requirement should therefore be explicitly integrated in engineering education. In this article, we analyse how this nexus between ethics and risk management is expressed in the engineering education research literature. It was done by reviewing 135 articles published between 1980 and March 1, 2016. These articles have been selected from 21 major journals (...) that specialize in engineering education, engineering ethics and ethics education. Our review suggests that risk management is mostly used as an anecdote or an example when addressing ethics issues in engineering education. Further, it is perceived as an ethical duty or requirement, achieved through rational and technical methods. However, a small number of publications do offer some critical analyses of ethics education in engineering and their implications for ethical risk and safety management. Therefore, we argue in this article that the link between risk management and ethics should be further developed in engineering education in order to promote the progressive change toward more socially and environmentally responsible engineering practices. Several research trends and issues are also identified and discussed in order to support the engineering education community in this project. (shrink)

Multiscale modeling techniques have attracted increasing attention by philosophers of science, but the resulting discussions have almost exclusively focused on issues surrounding explanation (e.g., reduction and emergence). In this paper, I argue that besides explanation, multiscale techniques can serve important exploratory functions when scientists model systems whose organization at different scales is ill-understood. My account distinguishes explanatory and descriptive multiscale modeling based on which epistemic goal scientists aim to achieve when using multiscale techniques. In explanatory multiscale modeling, scientists use multiscale (...) techniques to select information that is relevant to explain a particular type of behavior of the target system. In descriptive multiscale modeling scientists use multiscale techniques to explore lower-scale features which could be explanatorily relevant to many different types of behavior, and to determine which features of a target system an upper-scale data pattern could refer to. Using multiscale models from data-driven neuroscience as a case study, I argue that descriptive multiscale models have an exploratory function because they are a sources of potential explanations and serve as tools to reassess our conception of the target system. In den moralphilosophischen Debatten der Gegenwart besteht eine Tendenz, bei der Entwicklung neuer Ansätze auf Elemente antiker Theorien zurückzugreifen, wobei v. a. die Ethik des Aristoteles eine wichtige Rolle spielt. Am Anfang dieses Rückgriffs auf die Antike steht eine grundlegende Kritik an modernen Ethik-Konzeptionen. Um die Wiederbelebung der aristotelischen Ethik zu verstehen, ist es sinnvoll, sich zunächst diese Kritik vor Augen zu führen.

This paper concerns Aristotle's kind‐crossing prohibition. My aim is twofold. I argue that the traditional accounts of the prohibition are subject to serious internal difficulties and should be questioned. According to these accounts, Aristotle's prohibition is based on the individuation of scientific disciplines and the general kind that a discipline is about, and it says that scientific demonstrations must not cross from one discipline, and corresponding kind, to another. I propose a very different account of the prohibition. The prohibition is (...) based on Aristotle's scientific and metaphysical essentialism, according to which a scientific demonstration must take as its starting point a set of per se properties of a subject, if these make up a single, unitary definition. The social sciences are facing numerous crises including those related to replication, theory, and applicability. We highlight that these crises imply epistemic malfunctions and affect science communication negatively. Several potential solutions have already been proposed, ranging from statistical improvements to changes in norms of scientific conduct. In this paper, we propose a structural solution: the elimination of the discussion section from social science research papers. We point out that discussion sections allow for an inappropriate narrativization of research that disguises actual (...) results and enables the misstatement of true limitations. We go on to claim that removing this section and outsourcing it to other publications provides several epistemic advantages such as a division of academic labour, adversarial modes of progress, and a better alignment of the personal aims of scientists with the aims of science. After responding to several objections, we conclude that the potential benefits of moving away from the traditional model of academic papers outweigh the costs and have the potential to play a part in addressing the crises in the social sciences alongside other reforms. As such, we take our paper as proffering a further potential solution that should be applied complimentarily with other reform movements such as Open Science and hope that our paper can start a debate on this or similar proposals. In German-speaking countries, John Dewey came to be considered a school reformer, an advocate of the project method and as the propagator of a cognitivistic psychology of learning. His ideas on socio-political reform, on the other hand, were ignored, partly intentionally, partly due to a lack of familiarity with them in detail. His major pedagogical work,Democracy and Education received little attention. In what follows, this selective view of Dewey is discussed mainly on the basis of internal pedagogical theoretical positions.

In the pages of this journal, a fruitful debate has evolved on the ethical legitimacy of fractional-reserve banking. In this article, we respond to the new arguments raised by Evans as we clarify our position on the unethical and illegitimate nature of fractional-reserve banking. Fractional-reserve banking is not a recent financial innovation but represents a long-standing legal aberration. The co-mingling of two mutually exclusive financial contracts, deposit and loan, confounds the contracting parties’ purposes, intents, rights, and obligations. As a result, (...) it creates unsolvable legal difficulties and ethical dilemmas. While these problems are most evident in the case of a bank run, they also arise when trying to answer the simple question of “who owns a deposit?”. (shrink)

Clinical mental health researchers may understandably struggle with how to incorporate biological assessments in clinical research. The options are numerous and are described in a vast and complex body of literature. Here we provide guidelines to assist mental health researchers seeking to include biological measures in their studies. Apart from a focus on behavioral outcomes as measured via interviews or questionnaires, we advocate for a focus on biological pathways in clinical trials and epidemiological studies that may help clarify pathophysiology and (...) mechanisms of action, delineate biological subgroups of participants, mediate treatment effects, and inform personalized treatment strategies. With this paper we aim to bridge the gap between clinical and biological mental health research by (1) discussing the clinical relevance, measurement reliability, and feasibility of relevant peripheral biomarkers; (2) addressing five types of biological tissues, namely blood, saliva, urine, stool and hair; and (3) providing information on how to control sources of measurement variability. This article sheds light on a today mostly forgotten though highly influential thinker: Theodor Lipps. It explores the notion of ‘tendency’ in his work, a hitherto insufficiently examined yet central concept of the Munich philosopher. More specifically, the paper examines how Lipps utilizes the term to describe important structures of experience. By illuminating the various ways in which Lipps refers to tendencies, it aims to reconstruct important pillars of his theory of experience. This theory emphasizes that experience has a teleological (...) character, striving towards the complete determination and realization of the objects as they are represented (_vorgestellt_) in our experience. As will be shown, the description of different tendencies serves Lipps to conceptualize the laws that govern the related dynamics of our psychic life and to distinguish and examine the diverse range of conscious phenomena within it. To unveil the core ideas that guide Lipps’s development of his proposal, the article will first identify and reconstruct the primary source for his philosophical analysis of the mind’s motions: the metaphysics of Johann Friedrich Herbart. Subsequently, Lipps’s critical examination of Herbart’s proposal will be presented. This discussion will serve as a backdrop to illustrate how Lipps integrates Herbartian themes, reformulates related concepts, and ultimately develops his unique understanding of tendency and its roles in experience. By delving into his comprehensive analysis of tendencies, it will be argued that Lipps offers a version of Herbartianism. (shrink)

The Facts in the Case of Science. The article casts an eye on the role of scientific facts in relation to the circumstances, under which they emerge, and discusses the challenges for a history of science in a near future. The author assumes that science, the economy, ideologies, and religious belief will keep influencing each other. He recommends an open mind for new sources and pleads for interdisciplinary approaches.

The concept of elementary epimorphism is introduced. Inverse systems of such maps are considered, and a dual of the elementary chain lemma is found (Cor. 4.2). Borderline personality disorder (BPD) is characterized by severe disturbances in a subject’s sense of identity. Persons with BPD suffer from recurrent feelings of emptiness, a lack of self-feeling, and painful incoherence, especially regarding their own desires, how they see and feel about others, their life goals, or the roles to which they commit themselves. Over the past decade or so, clinical psychologists, psychotherapists, and psychiatrists have turned to philosophical conceptions of selfhood to better understand the borderline-specific ruptures in the sense (...) of identity, which are frequently associated with severe affective instability and turbulence in interpersonal relationships. Fuchs (2007) has suggested that these disturbances in self-experience can best be described and explained by using notions—widely discussed in philosophy and psychology—ofnarrativityandnarrative identity. On such a narrative view, key features of BPD present significant modifications of proto-narrative structures and inhibit the development of a narrative identity, resulting in a disturbed sense of identity. Although the role of narrativity in BPD has been acknowledged by many researchers, some have voiced dissatisfaction with what they take to be limitations of a narrativistic understanding of the disorders of identity characterizing BPD, and have proposed alternative, allegedly non-narrativistic, accounts. In this paper, we critically examine an example of the latter, viz. Gold and Kyratsous’ (2017) account ofthe person as an intrapersonal team reasoner. We defend a narrativistic understanding of BPD identity disorder against their objections. To this end, we propose a broader, and more finely-differentiated, concept of narrativity. On this account, four aspects of narrativity are distinguished, the disordering of which can affect those with BPD. As it turns out, our account implies that even Gold and Kyratsous—in order to ground their approach—must either make use of these aspects or propose an as-yet unarticulated alternative. This casts doubt upon whether their approach is non-narrativistic after all. (shrink)
